1. Identity and address of the data controller

Green Island Solutions, S.A. de C.V., operating under the GIS Power brand, with its address at Parque Industrial Jurica, Acceso A #104-B, Jurica, Querétaro, Qro., C.P. 76127, is the controller of the personal data you provide through this site, by email, by phone or by WhatsApp.

2. Personal data we collect

Only what we need to reply

Through this site’s form we collect: name, email, company, phone, profile (for example, whether you have a project or are an investor), project demand or size, location (state or country), project stage and the message you write. Only your name and email are required.

Along with the message, we record the page it was sent from and the date and time. To prevent automated submissions, the server keeps an encrypted fingerprint (hash) of your IP address for one hour, which cannot be used to reconstruct it.

We do not collect sensitive personal data. We do not ask for card or bank account details through this site. We treat the technical or commercial information you share about your project as confidential.

3. Purposes of processing

Primary and secondary, kept separate
01

Primary purposes

Replying to your request; assessing your project or your interest as an investor; preparing and presenting technical, financial or investment proposals; and following up on any resulting business or contractual relationship. These purposes are necessary to serve you.

02

Secondary purposes

Sending you technical, regulatory or new-project information from GIS Power. They are not necessary to serve you, and you may opt out at any time without affecting your request.

03

What we do not do

We do not sell, rent or trade your data. We do not use it for third-party advertising profiles. We do not publish your name or your company’s as a reference without your written authorization.

4. How to limit the use or disclosure of your data

If you do not want us to process your data for secondary purposes, write to info@gis-power.com with the subject "Unsubscribe", or reply with that word to any email we send you. You can also ask us not to share your information with group companies (section 5); in that case, some requests could not be handled.

5. Transfers and processors

Who your data is shared with

Processors. Our corporate email provider, this site’s hosting provider and, where applicable, our web analytics provider process your data on our behalf, only for the purposes of this notice. They are bound by confidentiality.

Group companies. When your request belongs with another PMI International Group company, or to assess a project together with it, we may transfer your data to it. This transfer does not require your consent because it is made to a company of the same group (art. 36, sec. III, of the Law).

For a contract in your interest. If the project requires it (for example, with a lender or an equipment supplier taking part in a proposal for you), we share only what is strictly necessary (art. 36, sec. IV, of the Law).

Outside these cases and duly grounded requests from authorities, we do not transfer your data. Any third party that receives it assumes the same obligations toward you as GIS Power (art. 35 of the Law).

6. Your ARCO rights and withdrawal of consent

Access, rectification, cancellation and objection
01

What you can request

To know what data we hold about you and how we use it; to correct it if it is inaccurate or incomplete; to have it cancelled; to object to its use for specific purposes; and to withdraw the consent you gave us.

02

How to request it

An email to info@gis-power.com with the subject "ARCO rights", including: your name and a way to reply to you; a document proving your identity or, where applicable, that of your representative; a clear description of the data and the right you wish to exercise; and anything else that helps locate your data (art. 28 of the Law).

03

Timelines

We send you our decision within 20 business days of receiving your request and, if it is granted, carry it out within the following 15 business days. Both periods may be extended once, for an equal period, if the case justifies it (art. 31 of the Law).

04

Cost

Exercising ARCO rights is free of fees. Only reproduction, copying or shipping costs may be charged (art. 34 of the Law).

05

If you are not satisfied

You may file a data protection request with Mexico’s Ministry of Anti-Corruption and Good Governance (Secretaría Anticorrupción y Buen Gobierno) within 15 days of our reply, or once the deadline expires if we did not reply (arts. 2, sec. XV, and 40 of the Law).

06

Retention

We keep your data for as long as it is needed for the purposes of this notice and any relationship arising from them. It is then blocked and cancelled, as the Law provides.

7. Data retention

How long and why

We keep your data for as long as it is needed to respond to your request and, if a business relationship is established, for as long as it lasts. When it is no longer needed, we block it: it is kept without being used, only to address any liability arising from its processing, and at the end of that period we delete it (LFPDPPP, arts. 10 and 24).

The blocking period equals the limitation period for claims arising from the relationship that gave rise to the processing. In commercial matters, the ordinary limitation period is ten years, and records of transactions must be kept for at least ten years (Commercial Code, arts. 1047 and 38). For that reason, the maximum retention period for your data is ten years from our last contact or, where applicable, from the last transaction.

8. Cookies and similar technologies

This site may use web analytics cookies to measure, in aggregate, how it is used: pages visited, time on site, device and browser type, traffic source and an approximate city-level location. That information is used only to improve the site and is not combined with form data to identify you.

The site does not use advertising cookies. You can block or delete cookies in your browser settings; the site will keep working.

9. Changes to this notice

Any change to this notice is published on this page with its update date. If a change is substantial regarding purposes or transfers, we will also notify you at the email address you gave us.
